This Privacy Policy explains how we collect, use, disclose, and protect information when you visit sunseisunscreen.com (or any successor domain), purchase our products through our website and any online or social commerce channels through which we sell our products, sign up for our email list, or otherwise interact with us (collectively, the "Services"). By using the Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Services.

1. Information We Collect

Information You Provide to Us

  • Contact and order information: name, billing and shipping address, email address, and telephone number.

  • Payment information: processed directly by our third-party payment processors (e.g., Shopify Payments, PayPal). Sunsei does not store full payment card numbers on our own servers.

  • Order history and customer service communications.

  • Account information, if you create an account (email, password, saved addresses).

  • Content you submit voluntarily, such as product reviews, survey responses, or contest entries.

Information Collected Automatically

  • Device and usage data: IP address, browser type, device identifiers, operating system, pages viewed, time on site, referral source, and approximate location derived from IP address.

  • Cookies and similar technologies (see Section 3, "Cookies and Tracking Technologies").

Marketing and Communications Information

  • Email, communication preferences, and engagement with our marketing messages (opens, clicks).

2. How We Use Your Information

  • Process, fulfill, and ship orders, and communicate with you about them.

  • Provide customer support and respond to inquiries.

  • Operate, maintain, and improve our website, products, and customer experience.

  • Personalize content and product recommendations.

  • Detect, investigate, and prevent fraud, abuse, and security incidents.

  • Comply with legal, tax, accounting, and regulatory obligations, including FDA sunscreen labeling and safety recordkeeping requirements.

  • Send marketing communications by email if you opt in.

  • Conduct analytics and measure the performance of our marketing campaigns.

3. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, SDKs, and similar technologies for the following purposes:

  • Essential/Functional: cart functionality, checkout, account login, and site security (via Shopify).

  • Analytics: understanding site traffic and usage (e.g., Google Analytics).

  • Advertising: delivering and measuring ads across platforms such as Meta, Google, and TikTok (e.g., Meta Pixel, TikTok Pixel, Google Ads tags).

You can manage cookie preferences through our cookie consent banner, your browser settings, or the opt-out mechanisms described in Section 5 below. Note that blocking certain cookies may affect site functionality.

4. How We Share Your Information

We share information with:

  • Service providers who perform functions on our behalf, including Shopify (e-commerce platform and payments), TikTok Shop, shipping and fulfillment carriers, customer support tools, and email marketing platforms.

  • Advertising and analytics partners, such as Meta, Google, and TikTok, for the purposes described in Section 3.

  • Professional advisors and regulators, including the FDA, where required for compliance.

  • A successor entity in the event of a merger, acquisition, financing, or sale of assets.

  • Law enforcement or other parties when required by law, subpoena, or legal process, or to protect the rights, property, or safety of Sunsei, our customers, or others.

We do not sell personal information for money. However, sharing data with advertising and analytics partners (such as the Meta, Google, and TikTok pixels referenced above) may be considered a "sale" or "share" of personal information under certain state privacy laws, including the CCPA. See Section 5 for how to opt out of this sharing.

5. Your Privacy Rights

California and Other State Privacy Rights

If you are a California resident, the CCPA/CPRA gives you the right to: know what personal information we collect, use, and disclose; request deletion or correction of your personal information; opt out of the "sale" or "sharing" of your personal information (including for cross-context behavioral advertising); and not be discriminated against for exercising these rights.

We do not knowingly sell or share the personal information of consumers we know to be under 16 years old without opt-in consent (and, for consumers under 13, verifiable parental consent).

To submit a request, contact us at info@sunseisunscreen.com, or use the "Your Privacy Choices" / "Do Not Sell or Share My Personal Information" link at the bottom of our website. We will verify your request using information such as your name, email, and order history, and will respond within the time required by applicable law (generally 45 days for California, extendable once by an additional 45 days).

If you are a resident of Colorado, Connecticut, Virginia, Utah, Oregon, Texas, or another state with a comprehensive consumer privacy law, you may have similar rights, including the right to appeal a denied request. To appeal, contact us using the information in Section 12.

Marketing Opt-Out

  • Email: click "unsubscribe" at the bottom of any marketing email.

  • Targeted advertising: use the opt-out link described above, or your browser/device privacy settings.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including processing orders, complying with tax, accounting, and product-safety recordkeeping obligations, resolving disputes, and enforcing our agreements. When information is no longer needed for these purposes, we delete or de-identify it.

7. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information, including relying on the security infrastructure of our platform providers (e.g., Shopify's PCI-compliant payment processing). No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Children's Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent, in accordance with the Children's Online Privacy Protection Act (COPPA). Separately, purchases through our Services require that the purchaser be at least 18 years old, or have parent/guardian permission, as set out in our Terms and Conditions. If we learn that we have collected personal information from a child under 13 without appropriate consent, we will delete it.

9. International Visitors

Sunsei ships internationally. If you are located outside the United States, your personal information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your jurisdiction. By using our Services or placing an order, you consent to this transfer.

If you are located in the European Economic Area, the United Kingdom, or Switzerland: you may have additional rights under the GDPR or UK GDPR, including the right to access, correct, delete, or port your personal data, and the right to lodge a complaint with your local data protection authority. Our legal basis for processing your information includes performance of a contract (fulfilling your order), our legitimate interests (e.g., fraud prevention, marketing to existing customers), and your consent (e.g., marketing opt-ins). 

10. Third-Party Websites and Services

Our Services may contain links to third-party websites, including social media platforms and payment processors. We are not responsible for the privacy practices or content of third-party websites. We encourage you to review the privacy policies of any third-party site you visit.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Changes are effective immediately upon posting the revised version, with the "Effective Date" updated accordingly. Material changes affecting how we use previously collected information will be communicated as required by applicable law.
